Definitions:
“EFTPOS Promotional Card” means a card with stored value that is able to be used as a debit card wherever EFTPOS is available.
“Participant” means a resident of (or entity trading in) Australia, who is eligible for a JCB reward or promotional program in Australia run by the Company.
“Company” means CFC Holdings Pty Ltd (ACN 008 777 348) trading as JCB Construction Equipment Australia, PO Box 3113, Bassendean, WA 6942.
“Promotion” means various JCB Construction Equipment Australia promotions run from time to time in Australia.
- All Reward values are in Australian dollars, are inclusive of GST and are correct at the time of printing. Liability for any tax on any prize provided to Participants from this promotion will be the sole responsibility of the Participant. If in doubt as to the tax liability arising in connection with Rewards, Participants should contact their own accountant or taxation advisor in this regard.
- The Company’s decision on all matters pertaining to this Promotion is final and binding and no correspondence will be entered into, except as otherwise stated in these terms and conditions.
- The EFTPOS Gift Card can be used at retail stores where the EFTPOS machine/capability is available. The EFTPOS Gift Card will be accepted at the sole discretion of the retailer. The Company will not be responsible for any card being declined by any retailer.
- To the extent permitted by law, the Company shall not be liable for any fault pertaining to, or purchased using, the Reward. Participants will need to liaise directly with the manufacturer of the Reward or item purchased for any repair and/or replacement.
- The Company will accept no responsibility for late, lost or misdirected mail. Further the Company shall not be liable for any loss or damage whatsoever which is suffered (including, without limitation, indirect, consequential or economic loss), or for any personal injury suffered or sustained, as a result of participating in this promotion, except for any liability which cannot be excluded by law. Further, to the fullest extent permitted by law, the Company excludes liability for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or any website, or any unauthorized intervention, or any combination thereof, including any non-delivery or corruption of entries to the Company, injury or damage to Participants' or any other person’s computer related to or resulting from participation in or down-loading any materials in this Promotion.
- Rewards are not transferable.
- The Company reserves the right to update these terms and conditions at any time without prior notice.
These terms and conditions shall be governed by and construed in accordance with the laws in force in Western Australia.
